Welcome to Hostoria. By accessing, browsing, or using our website or services ("Hostoria", "we", "us", "our"), you agree to comply with and be bound by the following Terms and Conditions ("Terms") as well as our Privacy Policy. If you do not agree with these Terms, you must not use our services.

1. Definitions

  • User: Any individual or legal entity that accesses or uses Hostoria services.

  • Products: Any digital hosting services, game server rentals, or related offerings provided by Hostoria.

  • EULA: The End-User License Agreement, which applies to any software or configuration provided by Hostoria.

  • Tebex: A third-party payment processor acting as a reseller for certain Hostoria digital goods.

2. Acceptance of Terms

By using our services, you confirm that you are at least 18 years old, legally capable of entering into binding contracts, and that you have read and agree to these Terms, our Privacy Policy, and any applicable EULA. Your continued use of Hostoria services constitutes acceptance of any future updates to these Terms.

3. Intellectual Property and Licensing

  • All content, server configurations, tools, and custom features provided by Hostoria are the intellectual property of Hostoria or its licensors.

  • Users are granted a limited, non-exclusive, non-transferable license to use our services for personal or commercial game hosting, depending on the package.

  • You may not resell, sublicense, copy, or redistribute any Hostoria content or service unless explicitly authorized in writing.

4. Lawful Use Only

Hostoria services may only be used for legal activities. You agree not to use our services to host or distribute:

  • Malware or illegal software

  • Hateful, abusive, or discriminatory content

  • Pirated game servers or content violating game publishers’ terms

We reserve the right to report illegal activities to authorities.

5. Appropriate Use and Server Abuse

By using Hostoria, you agree not to:

  • Attempt unauthorized access or hack our infrastructure

  • Upload malware or overburden our servers

  • Run illegal game servers (e.g. cracked Minecraft or FiveM in breach of Rockstar's terms)

  • Exploit bugs or misuse services in a way that affects others

Violation of this clause may result in immediate account suspension or termination without refund.

6. Modifications and Uptime

  • Hostoria strives to provide 99.9% uptime but cannot guarantee uninterrupted service.

  • We reserve the right to update, patch, or modify servers and services at any time to improve performance or security.

  • Emergency maintenance may occur without prior notice.

7. Support

  • We provide technical support via email ([email protected]) during regular business hours.

  • Support covers hosting-related issues, not in-game or third-party mod support.

  • Abuse of support channels may result in service limitations.

8. Payments and Billing

  • All payments must be made in full upfront.

  • Services are provisioned automatically upon successful payment.

  • No refunds are given once services have been provisioned, unless legally required under Swiss law.

  • For recurring services, it is the user's responsibility to cancel before renewal. We do not offer partial refunds for unused time.

9. Tebex Clause (If Applicable)

For purchases processed via Tebex:

  • We partner with Tebex Limited (www.tebex.io), who are the official merchant of digital content produced by us.
  • If you wish to purchase licenses to use digital content we produce, you must do so through Tebex as our licensed reseller and merchant of record.
  • In order to make any such purchase from Tebex, you must agree to their terms, available at https://checkout.tebex.io/terms.
  • If you have any queries about a purchase made through Tebex, including but not limited to refund requests, technical issues or billing enquiries, you should contact Tebex support at https://www.tebex.io/contact/checkout in the first instance.

10. Limitation of Liability

To the maximum extent permitted under Swiss law:

  • Hostoria is not liable for any loss of data, revenue, or damages arising from downtime, service abuse, or account misuse.

  • All services are provided "as is" without any warranties, express or implied.

11. Termination

We reserve the right to terminate your access to Hostoria services without notice if you violate these Terms, the EULA, or any applicable law. You may not create a new account if your previous account was suspended or banned.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the use of Hostoria services shall be subject to the non-exclusive jurisdiction of the courts in Glarus, Switzerland.
